Domestic Violence
It is possible to apply for an injunction
order in cases of domestic disturbance to prevent the use
or threat of violence whether this is directed by one party
to the relationship towards the other, or towards the child
or other relative living in the same property. Courts can
make orders to force the violent person to leave the home
that they occupy if this is necessary for the safety of
the other partner, even if the violent person is the sole
owner of the property, although in this situation the order
will be of a limited duration. If there is extreme violence
the Courts can attach a penal notice to a injunction order.
This enables the police make an arrest in the event of the
order being breached.
