DIVORCE PROCEDURE
Grounds
A divorce may be applied for if the marriage
has irretrievably broken down, which is proved by one of five
facts (or grounds) :
a) Adultery - That the respondent has
committed adultery and the petitioner finds it intolerable
to live with the respondent.
b) Unreasonable behaviour - That the
responded has behaved in such a way that the petitioner cannot
reasonably be expected to live with the respondent.
c) 2 year's desertion - That the respondent
has deserted the petitioner for a continuous period of at
least two years immediately preceding the presentation of
the petition.
d) 2 year's separation with consent
- That the parties to the marriage have lived apart for a
continuous period of at least 2 years immediately preceding
the presentation of the petition and the respondent consents
to the decree being granted.
e) 5 year's separation - That the parties
to the marriage have lived apart for a continuous period of
at least 5 years immediately preceding the presentation of
the petition.
